Cycling Tour Terms and Conditions

The trip terms and conditions regulate the relationship between the customer and velonobilis and the rare case that there is a divergence of the trip booking or transaction from the normal booking or transaction. They correspond to the legal regulations and rights of the general business services and supplement the legal rules of the trip’s contract rights. The participant acknowledges the tour’s conditions upon booking. Please carefully read through the following text. Pay extra notice that there is a necessary minimum attendance requirement for all offered trips.

1. Registration

Trip registrations can be made by telephone, post or fax. Upon the registration, velonobilis offers the customer a binding trip contract that assumes the particular trip’s prices and associated program description. The contract comes into effect through velonobilis confirmation. The person responsible for signing the contract assumes personal responsibility for all registered persons on the form and also for all associated obligations that are in relation to the individual and the listed participants. If the content of the travel confirmation differs from the content of the original registration, the travel confirmation is to be understood as a new velonobilis offer that the customer can accept within five days by explicit or implied confirmation (for example by paying the fee of the trip or by paying a deposit).

2. Down Payment/ Final Payment

Upon trip confirmation, a 15% down payment of the total trip cost (per person) is due to the bank account... The final payment is due at the latest 28 days before trip commencement to the aforementioned bank account. Upon receipt of the full velonobilis trip payment, a detailed tour itinerary will be sent.

3. Service and Prices

The services contained in the travel price fit the travel confirmation and its associated itinerary as specified and are binding with the travel contract. The ranking of a hotel or another accommodation of the customers mentioned in the travel description refers to a classification used in the area of the travel destination. Velonobilis is entitled to change the content of the travel contract in the event that a particular service of the travel contract cannot be fulfilled by velonobilis due to reasons beyond the control of velonobilis, or, if the fulfilment of single services by velonobilis becomes unexpectedly and due to reasons beyond the control of velonobilis economically unreasonable. Changes and deviations from the agreed content of the individual travel services after signing the contract are permissible if they have become necessary for obvious reasons and are brought up by velonobilis, as long as the changes and deviations are minor and do not impact the overall arrangement of the trip. In particular, the reservation of an additional room in another accommodation or the arrangement of a group in another overnight accommodation (a comparable one where possible) may be necessary. Should the customer forgo individual paid services such as hotel accommodation, meals, transportation, etc. because of ending the journey early or other reasons non attributable to velonobilis, the traveller is not entitled to a prorated refund. All prices are exclusively for travel in the given calendar year. Guests will be informed immediately after velonobilis becomes aware of changes to the travel service, trip cancellation or a price increase. Should there be a price increase of more than 5% the original travel fare or a significant change in a major service component, the customer is entitled to rescind the contract or - also in case of a valid cancellation of a travel trip by velonobilis - participate in an equivalently-priced journey so long as velonobilis can still offer a comparable trip without additional charge. The traveller is obliged to claim these rights immediately upon receipt of the change notification asserted by velonobilis.

4. Change of Reservation

A change of reservation for a different trip or in respect to changes in travel dates, travel destination, location of the trip commencement or conlusion point , accommodation or type of transportation, velonobilis is entitled to charge EUR 30,-  per person for the change. Should no other customer fill the freed up space, the change of reservation will be processed as a travel cancellation followed by a new and independent registration for another trip. 

5. Cancellation of the Travel Contract by the Customer

A cancellation of the travel contract prior to departure is always possible. In the case of cancellation, velonobilis is entitled to compensation in regards to the amount of otherwise saved expenditures to that date. The compensation is calculated as follows:

The customer is entitled to demonstrate to velonobilis that a financial damage to velonobilis has not occurred or that the financial damage is lower than the above-mentioned ratios. Should another trip participant fill the freed place that opens from cancellation, only compensation of EUR 30,- per person will be charged.
To cover the cost risk in case of a cancellation of a trip velonobilis strongly suggests signing an individual travel cancellation insurance that is not included in the price velonobilis trips.

6. Cancellation of a Trip by Velonobilis

6.1. Without Prior Notice  
If, despite appropriate warning, a participant repeatedly endangers and/or does not respect the wishes for the other participants to have a smooth trip and their expectations to follow the planned itinerary during the trip, velonobilis can immediately terminate the travel contract prior to its expiry date. Velonobilis reserves the right to keep the travel fare in this case. The party concerned is responsible for any extra costs associated with the return trip.
6.2. More than 2 Weeks before Trip Commencement
Velonobilis reserves the right to cancel a trip up until two weeks prior to trip commencement should the minimum of six participants not be reached. As accepted in the travel conditions, velonobilis is required to immediately inform and provide an explanation to customers should the trip be cancelled. If it is known in advance that the participant number minimum cannot be reached, the tour operator will inform the participants. In this case, the full fare will be reimbursed.
6.3. Contract Cancellation due to Unforeseen Circumstances
Both velonobilis and the customer may terminate the contract should unpredictable forces posing difficulty, threat or damage occur (force majeure clause). Should the contract be cancelled, velonobilis is entitled to demand an an adequate compensation for travel services that have been provided and for services that have to be  provided in order to terminate the trip. Additional costs fall on the traveller.

7. Protection in the Event of Insolvency

Insolvency travel insurance applies to the rights of all travel contract guidelines. In the case of tour operator insolvency, the travel fare and associated costs will be repaid to the customer. The issued insurance certificate guarantees these insurance services.

8. Liability

velonobilis is liable under the care of an ordinary businessman for the diligent trip preparation, the careful selection and monitoring parties offering services, the accuracy of the descriptions in the offer and the proper provision of travel services agreed. The trip participants are individually responsible for the observance of traffic regulations (German StVO). The assessment of personal capabilities and physical fitness is the always responsibility of the individual participant. The customer is liable for damages caused to other parties. He/she is advised to have personal liability insurance for these cases. The liability for damages, not physical injuries, is limited up to triple the amount of the tour price, so long as the damage has been caused by gross negligence or intentionally by velonobilis, or if velonobilis is responsible for damage to a passenger solely because of a service provider failure. The liability of velonobilis for damages from tortuous acts, not physical injury, is excluded, unless the damage is caused intentionally or by gross negligence. Velonobilis is not liable for service disruptions associated with other services, which are labelled as such in the travel description. This applies, for example, to transport services by rail, bus or boat or in rental cars. An additional insurance against risks associated with travelling, paid for at the participant’s own expense, is strongly recommended. Velonobilis provides the participants during the journey with a rental bicycle free of charge (except for day tours). If the participant wants to use a personal bicycle, velonobilis does not assume any liability for personal injuries of the participating cyclist or for property damage or theft of the brought bicycle, unless they occur through gross negligence on the part of velonobilis.

9. Reclamations, Obligations from Contract

Should, despite the utmost care that velonobilis is taking for the planning and implementation of these trips, there still exist a cause for complaint, the tour participants are entitled to the warranty rights such as relief, self-relief, reduction of fare, termination of the contract and liquidated damages only if it is not culpably forgotten to announce such a complaint to velonobilis during the trip. A notification is only accepted by the management of velonobilis, Bisseer Weg 31, 24220 Schönhorst, tel +49 4347 - 7385641, fax +49 4347-904913. The tour guide is not entitled to accept any claims. The customer can only remedy, or in case of a significant deficiency, cancel the trip only if the participant previously allowed velonobilis a reasonable time to remedy the deficiency. Such a time period must not be accepted if the remedy is impossible or is denied by velonobilis or the immediate remedy is required by a special interest of the participant. If the tour is not carried out as described in the contact, the participants can require remedies. The tour operator may refuse the remedy, if they have a disproportionate burden. Warranty claims must be claimed within one month after the contractual end of the trip at the registered office of velonobilis at the specified address. After this deadline a claim can only be levied if the customer, without fault, was prevented to meet the deadline. Warranty claims become time barred within one year after the contractual end of the trip.

10. Other

Velonobilis assures that all personal data that are made available to the planning of the trip will not be forwarded. The traveller agrees on the electronic storage of his data by velonobilis and to the transfer of data for purposes directly related to the travel service (e.g. hotel reservations). The participant also agrees that his/her name and place of origin will be printed on a list of passengers  that is passed to all persons travelling with the group.
The participants are entitled to file charges against velonobilis at their registered place of office. For charges against participants by Velonobilis, the domicile of the participants is relevant, unless they are merchants or people who changed their domicile or habitual residence after the conclusion of the contract to a foreign country or unless those whose residence or whereabouts at the time of the charge is not known. In these cases, the seat of velonobilis is the responsible place of court.
For all claims arising from the travel contract, the law of the Federal Republic of Germany is binding.
Changes in the offer concerning the contents of the cycling tours because of important and higher reasons are reserved rights.
